Repairing and service charge clauses from every lease, in one table: tenant, clause, recoverable or not.

Headline result: The landlord cannot recover £25,800, which is 38% of the £67,500 works budget.

## What did the client ask for?

A Scottish property investment company had two retail tenants on one London block, on two different leases. Their director wanted to:

> Extract repairing obligations from all leases on an estate / block / retail park to understand what works are recoverable from tenants and where there is a Landlord’s liability for any shortfall in cost recovery

The Skill set both leases side by side and showed the shortfall before any work began.

## What did the check find?

- Unit 1 pays 60% and Unit 2 pays 40%, except where a lease excludes the item.
- Roof repairs cost £40,000. Unit 2’s roof is excluded, so the landlord pays £16,000.
- External redecoration of £12,000 is recoverable under both leases.
- Rear wall structural repair costs £9,500. Unit 2’s structure is excluded, so the landlord pays £3,800.
- The £6,000 fire alarm upgrade is an improvement excluded in both leases, so the landlord pays all of it.
